Welcome to EvenUS (“EvenUS”, “we”, “us”, or “our”), the household management application available through the mobile apps on the Apple App Store and Google Play Store and at https://evenus.app (collectively, the “Service” or “App”).

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms (including our Privacy Policy), you must immediately stop using the Service and uninstall the App.

These Terms form a legally binding agreement between you and Aapt Dubey (the developer and operator of EvenUS).

1. Description of the Service
EvenUS is a tool that helps couples and household partners track shared expenses, chores, and calculate a “Fairness Score” and “Labor Valuation”. These features are provided for informational and organizational purposes only and are not intended to replace professional financial, legal, or accounting advice.

2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the full legal capacity to enter into these Terms.

3. Account Registration and Security

• You must create an individual account to use most features.
• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information.
• You may invite a partner to share data. You represent and warrant that you have obtained their explicit consent before inviting them and sharing any personal data. Both you and your invited partner must each create individual accounts and accept these Terms. EvenUS is not responsible for any disputes or misuse that arises from partner invitations you initiate.

4. User Conduct
You agree not to:

• Use the Service for any illegal purpose or in violation of applicable laws (including without consent of your partner).
• Upload, post, or transmit any content that is abusive, defamatory, obscene, or violates the privacy or rights of others.
• Invite or share data with anyone without their explicit prior consent.
• Attempt to reverse-engineer, decompile, disassemble, or scrape the Service or the Fairness Score / Labor Valuation logic.
• Interfere with the security or proper functioning of the Service.

5. User Content and Data License
You retain ownership of all data and content you upload (“User Content”). By submitting User Content, you grant EvenUS a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, process, copy, display, and use your User Content solely as necessary to provide, maintain, improve, and operate the Service. This license survives termination of your account only as needed for backup, legal, or regulatory purposes.

6. Intellectual Property
All content, code, design, algorithms (including Fairness Score and Labor Valuation logic), trademarks, logos, and other intellectual property in the Service (excluding your User Content) are the exclusive property of Aapt Dubey. You are granted only a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial household use in accordance with these Terms.

7. No Financial or Legal Advice
The Service, including all Fairness Score and Labor Valuation calculations, is provided for informational purposes only. EvenUS is not a financial institution, accountant, lawyer, or advisor. We do not provide financial, legal, tax, or accounting advice. Any decisions you make based on data or scores from the Service are made entirely at your own risk. The Fairness Score is a subjective estimate based on user inputs and must not be used as evidence in legal proceedings, divorce settlements, debt collection, or any formal dispute resolution.

8. Fees and Subscriptions (Premium Features)

• Certain features may require a paid subscription (“Premium”).
• Subscriptions are billed on a recurring basis through the Apple App Store or Google Play Store (depending on the platform you use). Pricing and terms are shown at the time of purchase.
• You authorize the applicable store to charge your chosen payment method on a recurring basis.
• You may cancel your subscription at any time through your Apple or Google account settings. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial billing periods unless required by applicable law.
• We may change prices with notice; continued use after a price change constitutes acceptance.

9. Privacy and Data Protection
Your privacy is important. Please read our Privacy Policy (incorporated by reference). We process personal data in accordance with the Digital Personal Data Protection Act, 2023 (India) and other applicable privacy laws. By using the Service you consent to the collection, use, and sharing of your data as described in the Privacy Policy.

10. Disclaimers – “AS IS”
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE FAIRNESS SCORE WILL BE ACCURATE OR RELIABLE.

11. Limitation of Liability
To the maximum extent permitted by law, EvenUS, Aapt Dubey, and our affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages (including loss of data, profits, or goodwill) arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you have actually paid to us (if any) in the twelve (12) months immediately preceding the claim.

12. Indemnification
You agree to indemnify, defend, and hold harmless Aapt Dubey, EvenUS, and our officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (i) your violation of these Terms, (ii) your use or misuse of the Service, (iii) any disputes with your partner(s), or (iv) any User Content you provide.

13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason (including if we believe you have violated these Terms). You may stop using the Service at any time by uninstalling the App and canceling any subscriptions.

14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of India, without regard to conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana.

15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App and updating the Effective Date. Your continued use of the Service after the changes become effective constitutes your acceptance of the revised Terms.

16. Miscellaneous

• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
• Waiver: Our failure to enforce any right does not waive that right.
• Entire Agreement: These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Service.
• No Class Actions: To the extent permitted by law, any dispute shall be brought individually and not as part of any class action.
